GFCI and AFCI protection

Budget for it

A house is not defective for lacking protection that was not required when it was built.

Cheap, high-value and elective. A D on the report is not a builder defect.

What each device actually does

These are two different devices solving two different problems, and treating them as interchangeable is the fastest way to spot content written by someone who does not know the subject.

A GFCI protects people. A ground-fault circuit interrupter compares the current leaving on the hot conductor with the current returning on the neutral. If they differ, current is going somewhere it should not — through a person, through water, through a damp slab — and the device opens. A Class A GFCI, the residential type, is designed to trip when ground-fault current reaches approximately 6 milliamperes or higher, and not to trip below approximately 4 milliamperes — a personnel-protection threshold, deliberately far below anything that would bother a circuit breaker. Put simply: a GFCI protects you, a breaker protects the wire.

An AFCI protects the building. An arc-fault circuit interrupter is designed to recognise the electrical signature of an arcing fault — a loose terminal screw, a chair leg crushing a lamp cord, a nail driven through a cable during a remodel — and open the circuit before that arc ignites something. It is a fire-prevention device, not a shock-prevention device.

They are not substitutes. A dual-function breaker does both jobs, which is why it is the usual choice when retrofitting a kitchen or laundry circuit that needs each.

Why a missing device is not a code violation

This is the most important sentence on the page, and it is worth stating flatly: a house is not defective because it lacks protection that did not exist, or was not required, when it was built.

AFCIs did not appear in the National Electrical Code until 1999. A 1978 house in Plano with no AFCI protection anywhere is not out of code, was not built wrong, and does not contain a builder defect. It contains 1978 wiring, built to the 1978 rules, which is what it is supposed to contain. The correct frame for adding protection is safety improvement, not violation.

The same reasoning covers GFCI protection. A house built before bathrooms required GFCIs was not built incorrectly; the requirement arrived afterwards. Older work of this kind is legally nonconforming — lawfully installed under the rules in force at the time, and not required to be brought forward every time the code changes.

This distinction generates more argument in Dallas–Fort Worth transactions than almost any other line on a report, because the report says Deficient and the buyer reads violation. They are not the same word and they do not mean the same thing.

When each requirement arrived

The sequence below is the one given by IAEI Magazine, the publication of the International Association of Electrical Inspectors — authoritative within the trade, but a magazine article rather than the code text. Treat the years as the earliest possible date a requirement could apply, never as the date it applied locally.

GFCI protection, by NEC edition:

  • 1968 — underwater swimming pool lighting, the first appearance of GFCI in the Code.
  • 1971 — receptacles near pools, outdoor receptacles, construction sites.
  • 1975bathrooms.
  • 1978garages.
  • 1987kitchen countertop receptacles, as introduced tied to proximity to the sink; also hydromassage tubs and unfinished basements.
  • 1990 — crawl spaces.
  • 2005 — laundry and utility sinks.
  • 2014 — dishwashers, and expanded protection around bathtubs and showers.
  • 2020 — all basement receptacles regardless of finish, and expanded outdoor outlets under section 210.8(F).

The kitchen sequence is the one that matters most here. The 1987 edition first required GFCI protection at kitchen counter receptacles, but only for those within six feet of a sink. The 1996 edition removed the six-foot limitation and extended it to all kitchen countertop receptacles. A very large share of Dallas–Fort Worth housing was built between 1985 and 1999 — in Plano, 29.4% of the stock dates from the 1990s and 22.4% from the 1980s — straddling exactly that change. A 1990 kitchen with GFCI protection on the two receptacles nearest the sink and ordinary receptacles on the far wall was built correctly for its time.

AFCI protection followed a similar path: first required in 1999 for bedroom receptacle outlets with a delayed effective date; broadened to bedroom branch circuits in 2002; extended well beyond bedrooms to most habitable-room circuits in 2008, with combination-type devices required; extended to kitchens and laundry areas in 2014; and further clarified since. These dates come from trade consensus rather than from the code text and should be treated as approximate.

Which code applies in Texas right now

Current as of 7 August 2026. Texas adopts the National Electrical Code statewide for electrical work under the Texas Electrical Safety and Licensing Act, through 16 TAC §73.100. The rule presently reads: “Effective September 1, 2023, the department adopts the 2023 National Electrical Code as approved by the National Fire Protection Association, Inc. on August 12, 2022.”

That is about to change: the Texas Department of Licensing and Regulation has moved to adopt the 2026 NEC effective 1 September 2026, roughly three weeks after this was written. Readers arriving later should confirm the current adoption at TDLR.

The Texas carve-out for outdoor air conditioning equipment

NEC 210.8(F), introduced in the 2020 edition, requires GFCI protection for dwelling-unit outdoor outlets on single-phase branch circuits rated 150 volts to ground or less and 50 amps or less — which sweeps in the outdoor condenser. The 2023 edition extended it to garages at or below grade and accessory buildings, and applied it on equipment replacement. Manufacturers and contractors then reported nuisance tripping with inverter-driven and mini-split equipment, and an exception was added for listed HVAC equipment using power conversion equipment to control compressor speed.

Texas has gone further than the model code. The same rulemaking that adopts the 2026 NEC also modifies the HVAC exception by extending Exception No. 2 of 210.8(F) indefinitely, removing its original 1 September 2026 expiry. In plain terms: while the national code has been pushing outdoor equipment into GFCI protection, Texas is keeping outdoor HVAC equipment out of it.

That is why an inspection report cannot be read as a code checklist. Whether a non-GFCI-protected condenser disconnect is a finding depends on the edition, the jurisdiction and the date — three variables, not one.

And Texas sets only a floor. Municipalities adopt their own electrical ordinances on top of the state rule, along with regional amendments developed by the North Central Texas Council of Governments, whose Regional Codes Coordinating Committee has completed its review of the 2024 International Codes and the 2026 NEC. NCTCOG publishes code adoption surveys showing which edition each city is on. The authority having jurisdiction — the city building department — answers this for a specific address.

What TREC requires the inspector to report

Under the Texas Standards of Practice, the inspector shall report as Deficient the absence of GFCI protection in the locations the rule enumerates — bathrooms, garages, outdoor areas, kitchens and laundry areas — and the absence of AFCI protection in the enumerated living areas, including kitchens, family rooms, dining rooms and living rooms (22 TAC §535.229). The inspector shall also report deficiencies in the operation of a device that is installed.

Two limits go with that duty. The inspector is not required to determine code compliance, and is not required to test AFCI devices “when the property is occupied or when damage to personal property may result.” That second exclusion is real and frequently used, because testing an AFCI kills power to circuits that may be running a computer, a chest freezer or medical equipment. If a report notes that AFCIs were not tested for this reason, the inspector followed the rule.

The nuance worth internalising: because the rule requires reporting the absence of protection without regard to the age of the house, an REI 7-6 report on a 1990 Plano house will show D for missing AFCIs throughout. That is expected, correct, and not a builder defect. The report is telling you where the safety gaps are, not accusing anyone of building the house wrong.

What people get wrong

“The report says deficient, so it is a code violation the seller has to fix.” It is neither. Deficient is a reporting category defined by TREC's rule; a code violation is a determination made by a municipal inspector against the edition in force when the work was permitted. An inspector is expressly not required to determine code compliance, and no seller obligation is created by a D on a form.

“The AFCI keeps tripping, so it is defective.” Sometimes. But an AFCI that trips repeatedly may be doing precisely what it was installed to do, on a real fault in a real cable. Treat a repeatedly tripping device as information, not a nuisance to be bypassed.

“Everything works, so the device is fine.” Not the same test. A GFCI or AFCI that powers the circuit but does not trip when tested is worse than no device at all, because the occupant believes they are protected and behaves accordingly.

“The outdoor air conditioner is not GFCI protected, so something is wrong.” In Texas, as of this writing, the state has extended the HVAC exception indefinitely. The absence of GFCI protection at an outdoor condenser is not, by itself, a finding against the applicable Texas rule.

What to do about it

Missing GFCI protection in a wet location: budget for it, and do it. Inexpensive, high-value, elective safety work, and the best return per dollar of anything on an electrical report. Prioritise bathrooms, kitchen countertop receptacles, exterior receptacles, garage and laundry, in that order. Escalate to a full evaluation only if the missing protection comes with evidence of a wiring problem — no equipment ground, reversed polarity, an open neutral.

Missing AFCI protection in an older house: an elective upgrade to plan, not a demand to make. Worth doing, worth pricing, reasonable to phase over time. Check one constraint first: AFCI retrofit requires breakers made for that specific panel, and breaker availability for an obsolete panel may be limited or nonexistent — one of the quieter ways an ageing Federal Pacific or Zinsco panel compounds into a larger project.

A device that does not trip when tested: get it evaluated — as should a GFCI that trips and will not reset, or an AFCI that trips repeatedly. In each case the device is telling you something and an electrician should find out what.

Who does the work. A TDLR-licensed electrician. Replacing a GFCI receptacle is, in principle, within a competent homeowner's ability; AFCI and GFCI breaker work is inside an energised service panel and should not be presented as a DIY job.

What a fair negotiation looks like. Ask for the retrofit as a safety improvement you would like priced, not a defect the seller created; sellers respond badly, and correctly, to being told their 1988 house violates a code written in 2020. And if you are the seller, adding GFCI protection to the wet locations before listing removes a cluster of D lines from the report.

Common questions

My report says missing GFCI protection is deficient. Is my house out of code?

Almost certainly not. TREC's rule requires an inspector to report the absence of GFCI and AFCI protection in specified locations regardless of when the house was built, and the same rule states that the inspector is not required to determine code compliance. Deficient on an inspection report is a reporting category, not a legal finding. A house built before a requirement existed is legally nonconforming, which means it was lawfully built and is not required to be updated every time the code changes.

What is the difference between a GFCI and an AFCI?

A GFCI protects people from electric shock; an AFCI protects the building from fire. The GFCI compares current going out with current coming back and opens the circuit when the difference reaches about 6 milliamperes, which is far below anything a breaker would notice. The AFCI listens for the electrical signature of an arcing fault — a loose screw terminal, a damaged cord, a nail through a cable — and opens the circuit before it ignites anything. A dual-function breaker does both.

Why did the inspector not test the AFCI breakers?

Because the Standards of Practice do not require testing AFCI devices when the property is occupied or when damage to personal property may result. Tripping an AFCI cuts power to whatever is on that circuit, which in an occupied house can mean a running computer, a full freezer, an aquarium pump or medical equipment. It is a legitimate and commonly used exclusion. If you want the devices tested, arrange it with the occupant or have an electrician do it after closing.

Does my outdoor air conditioner need GFCI protection in Texas?

As of August 2026, no — Texas has taken a different path from the model code here. NEC 210.8(F), introduced in the 2020 edition, pulled dwelling-unit outdoor outlets including the condenser into GFCI protection, and the 2023 edition widened it further. After reports of nuisance tripping with inverter-driven and mini-split equipment, the state rulemaking extended the HVAC exception indefinitely rather than letting it expire. Confirm with the city building department for a specific address, because municipalities amend on top of the state rule.

Which edition of the NEC applies in Dallas-Fort Worth?

Texas adopts the NEC statewide through 16 TAC §73.100, which currently specifies the 2023 edition effective 1 September 2023, with the 2026 edition adopted effective 1 September 2026. That is a floor rather than the whole answer: individual cities adopt their own electrical ordinances and regional amendments developed through the North Central Texas Council of Governments, so the applicable detail in Plano, Frisco, Dallas and Fort Worth can differ. Should I ask the seller to add AFCI protection?

You can ask, but frame it as a safety upgrade you would like priced rather than a defect to be corrected, because on an older house it is the former. AFCI protection was not required in the National Electrical Code until 1999 and expanded well beyond bedrooms only in 2008, so a house built earlier was built correctly without it. Check one thing before assuming the retrofit is simple: AFCI breakers have to be made for that particular panel, and for an obsolete panel they may not exist.
